The process involves several steps, including meetings with the Social Welfare Department and legal documentation.

There are three legal options for unplanned pregnancy in Hong Kong, namely parenting (raising the child), adoption and termination of pregnancy (TOP, commonly known as abortion).

Apart from knowing the legal options, there are other aspects you need to consider when making a decision regarding your pregnancy. In this article series, we will explore the consideration for adoption.

The Best Interests of the Child

At its core, adoption is about ensuring that a child grows up in a loving, stable environment. Many mothers recognize that, due to various factors—be it financial instability, personal health issues, or lack of support—keeping their child may not be in the child’s best interest. In such cases, adoption can provide the child with opportunities that their birth mother may feel unable to offer.

Yet, despite these noble intentions, mothers who choose adoption often face societal stigma. Comments like, “Adoption is a form of throwing the baby away,” reflect a misconception that can lead to feelings of shame and inadequacy. In reality, adoption is an act of love and sacrifice. It requires immense courage to acknowledge that another family may be better suited to care for the child.

Adoption in Hong Kong

Adoption is legal in Hong Kong, following the region’s signing of the United Nations Convention on the Rights of the Child (UNCRC) in 1994. Unlike some countries where informal or private adoptions may be common, in Hong Kong, adoptions are only recognized as legal and binding when formalized through an “Adoption Order.” This ensures that the rights and welfare of all parties involved are protected within the adoption process.

The adoption process in Hong Kong is administered by the Adoption Unit under the Social Welfare Department (SWD).

Additionally, three NGOs were accredited by authority to make arrangements and proceed with both local and intercountry adoption. They are International Social Service Hong Kong Branch (ISS HK), Mother’s Choice Limited, Po Leung Kuk (as of 2024).

Adoption Procedures in Hong Kong

The procedures of adoption in Hong Kong are as follow (in order):

Meetings with Social Welfare Department (SWD)

Birth Registration

Temporary Child Care Home for the child

Goodbye visit

Sign-off legal documents

Make Ward

Matching

Foster home

Supervision/Visiting by SWD

Loving and permanent Family

Root tracing

*PathFinders is NOT an accredited body to provide adoption service and does not provide such service. However, if a MDW mother is considering this option, caseworkers at PathFinders can provide information and support for her to make an informed decision and guide her to access the service and resources provided by the aforementioned bodies.

The Emotional Toll on Birth Mothers

The decision to place a child for adoption is rarely straightforward. Mothers often experience a profound sense of loss, akin to grieving the death of a loved one. Studies show that the emotional journey can involve stages of grief, including denial, anger, bargaining, depression, and acceptance. Many mothers grapple with feelings of guilt and self-blame, questioning their worth as a parent and whether they have made the right choice.

It’s important to understand that this grief is a natural response to a significant life change. The feelings of loss and mourning can persist long after the adoption process is finalized. Support systems, whether through counseling, support groups, or understanding friends and family, are crucial in helping these mothers navigate their emotions.

Cultivating Understanding and Support

So, what can society do to support both the child and the birth mother during this challenging process? Here are a few key considerations:

Prioritize the Best Interests of the Child
Adoption should always center on what is best for the child. This includes ensuring that the child is placed in a nurturing environment where they can thrive. It’s essential for everyone involved in the adoption process—social workers, adoptive parents, and the community—to remain focused on the child’s needs.

Respect the Mother’s Decision
Rather than judging a mother’s choice, society should strive to understand the depth of her circumstances. Each situation is unique, and the decision to place a child for adoption is often made after careful consideration of various factors. Respecting this choice can help alleviate some of the stigma and pressure mothers feel.

Be Sensitive and Supportive
Those who know a mother considering adoption should approach the subject with sensitivity. Instead of offering unsolicited opinions, it’s more helpful to listen and provide emotional support. Understanding that every adoption story is personal can foster a more compassionate environment.

Adoption is a profound act that can change lives for the better, providing children with loving families and mothers with peace of mind about their child’s future. However, it is essential to recognize the emotional complexities involved in this decision. By prioritizing the best interests of the child, respecting the mother’s choice, and offering support, we can create a more understanding and compassionate society that honors the experiences of al involved.

In the end, adoption should be viewed not as a failure but as a hopeful beginning—a pathway to a brighter future for both the child and the mother.

Source: Unicef, Social Welfare Department, International Social Service Hong Kong Branch (ISS HK), Mother’s Choice Limited, Po Leung Kuk.

PathFinders is a charity that helps migrant domestic workers who have become pregnant, given birth to children in Hong Kong, or have overstayed their visa.
All our services are FREE of charge.

Learn more about PathFinders:
https://www.pathfinders.org.hk/en

For General Inquiries:
Email us at info@pathfinders.org.hk, or send us a message on our Facebook page (PathFindersHK / PathFinders for Migrant Workers).
Client hotline for pregnant migrant workers, or migrant domestic workers with children: +852 5190 4886.
